Terms and Conditions
1. Scope of Services:
- 1.1 Klean Kingdom agrees to provide services as specified in the agreed-upon proposal or work order.
- 1.2 Any additional services/variations requested by the customer will incur additional charges.
2. Pricing and Payment:
- 2.1 The customer agrees to pay the agreed-upon price for Klean Kingdom services.
- 2.2 Payment is due upon completion of the services unless otherwise agreed in writing.
- 2.3 Payments that are not made upon completion are subject to a $50 late payment fee and interest rate of 10% p.a. of the total amount payable.
3. Scheduling and Access:
- 3.1 The customer agrees to provide access to the property on the scheduled date and time for the provision of services.
- 3.2 In the event of unforeseen circumstances such as inclement weather, Klean Kingdom reserves the right to reschedule services.
4. Customer Obligations:
- 4.1 The customer is responsible for moving any obstacles or items that may hinder the provision of Klean Kingdom services.
- 4.2 The customer must inform Klean Kingdom of any special instructions or concerns regarding the property.
5. Cancellation and Rescheduling:
- 5.1 Cancellations made less than 24 hours before the scheduled service are subject to a cancellation fee of 20% of the accepted quote value.
- 5.2 Klean Kingdom reserves the right to charge a rescheduling fee for appointments changed within 24 hours of the scheduled time.
6. Property Condition, Outcome and Requirements:
- 6.1 While Klean Kingdom takes the utmost expert care, Klean Kingdom will not be held liable for any pre-existing damage or conditions that may be revealed during the course of the pressure washing.
- 6.2 Klean Kingdom is not responsible for damages due to improperly installed fixture & fittings, loose or broken roofing, opened windows, improperly sealed windows & doors, wood rot, defective construction, improperly secured wires, loose of improperly installed gutters & improper caulking. In every aluminium siding case & in some cases with vinyl siding, the sun & weather will bleach the colour or cause fading. Washing, which entails removal of chalky, gritty of failing surface materials may cause the faded aspects of the vinyl or aluminium to stand out. Klean Kingdom cleaning will not be responsible for loose mortar that may dislodge during the cleaning process.
- 6.3 Colour & Tone Concerns - The properties surfaces, oxidisation & weathering can greatly affect the resulting colour or tone of the stain. While we can often give you an idea of the overall colour or tone you must expect some variance in the overall finish.
- 6.4 Water Usage - By accepting this quotation, you agree to provide Klean Kingdom the right to use an on-site water supply as needed to complete the stated project without compensation. It is the customer's responsibility to make sure the water supply is in working order before we arrive.
- 6.5 Stains - some stains cannot be removed by washing. Tree sap, artillery fungus, splatters from stains & paints are examples of materials that cannot be removed from conventional means. We make every attempt to point these areas out to the customer. Sometimes they cannot be removed at all.
- 6.6 Watertight - Cleaning expects your property to be in good repair & weather tight. This includes, but not limited to all electrical service including receptacles & light fixtures. Doors & windows shall also be weathertight. Klean Kingdom is not responsible for damages as a result of water infiltration from poor or improper installation, maintenance or repair of electrical related items or doors or windows.
- 6.7 Window Spotting - windows may become water spotted as a result of our services. Unless Window cleaning is included.
- 6.8 Concrete - The appearance of concrete depends on factors linked to when it was initially poured & cured. When concrete is cleaned, it will often reveal any & all imperfections that the pollutants & stains have covered up. Note & understand that not all concrete will look the same.
- 6.9 Removal & Replacement of Deck Content/Furniture/Items - BBQ, outdoor furniture, planters & any other items are the responsibility of the owner and should be moved prior to commencement of work by the owner.. Should we need to remove items, we will not be responsible for any damage, breakage or for storage issues. An additional charge applies.
7. Warranty:
- 7.1 Klean Kingdom - All warranties are limited to those offered by the manufacturers of the product used. Klean Kingdom makes no additional warranties.
8. Safety:
- 8.1 Klean Kingdom will adhere to all safety standards and regulations during the provision of services.
- 8.2 The customer agrees to keep pets and children away from the work area during service provision.
9. Satisfaction Guarantee and Complaints:
- 9.1 Any complaints regarding the pressure washing services must be reported to Klean Kingdom within 48 hours of service completion.
- 9.2 Klean Kingdom will make reasonable efforts to address and resolve customer complaints in a timely manner.
10. Governing Law:
- 10.1 These terms and conditions are governed by the laws of New South Wales.
- 10.2 Any disputes arising from these terms and conditions will be subject to resolution through arbitration or the courts of New South Wales.
11. Customer Site Inspection - Pre and Post Work
- 11.1 Klean Kingdom will undertake a client walk through and inspection to ensure scope of works are adhered & satisfied.
12. Contract Termination
- 12.1.1 Unsafe Work Conditions: Klean Kingdom reserves the right to terminate any Agreement immediately, without notice to the Customer, if, in Klean Kingdom's reasonable judgment, continued performance of services would pose a safety risk or threat to Klean Kingdom's employees or their property or the property itself. Such safety risks may include, but are not limited to: Aggressive or unrestrained pets on the property during service. Unstable structures or surfaces posing a risk of collapse. The presence of unknown or undisclosed hazardous materials, electrical hazards, welding hazards etc. on the property. Any other condition that Klean Kingdom deems a safety hazard in good faith.
- 12.1.2 Customer Non-Compliance: In the event the Customer fails to comply with any material provision of this Agreement, including but not limited to: Failing to provide reasonable access to the property on the scheduled date and time. Failing to remove fragile items or properly secure the work area as instructed. Failing to disclose pre-existing damage or potential hazards on the property. Failing to make full payment for services rendered within the agreed-upon timeframe.
13. Indemnification
- 13.1 Customer's Obligation to Indemnify Klean Kingdom The Customer agrees to indemnify, defend, and hold harmless Klean Kingdom, its officers, directors, employees, agents, and affiliates (collectively, the "Indemnified Parties") from and against any and all claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees), including: Customer's Breach: Any breach of this Agreement by the Customer. Customer's Negligence: Any negligent or willful act or omission of the Customer or its agents, including but not limited to: Failure to disclose hazardous conditions or materials on the property before services commence. Injury to persons or property caused by the Customer or its agents during the service. Third-Party Claims: Any claims by third parties arising from the Customer's use of Klean Kingdom services.
- 13.2 Survival This indemnification obligation will survive the termination or expiration of the agreement between Klean Kingdom and the Customer.
- 13.3 Right to Defend Klean Kingdom reserves the right, at the customer's expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by the Customer. The Customer agrees to cooperate with Klean Kingdom's defense of such claims.
By engaging Klean Kingdom for services, the customer acknowledges and agrees to these terms and conditions. Klean Kingdom reserves the right to update these terms and conditions as needed, and any changes will be communicated to the customer in writing.
